General terms of business of NEEDFUL-THINGS.NL

§1. Scope

The terms of business set out here regulate the use of the internet-website www.needful-things.nl and all offers, services and costs associated therewith, as well as all agreements between Bruins Holding b.v. and the client insofar as these are connected to the online-shop NEEDFUL-THINGS.NL, provided by Bruins Holding b.v.

§2. Deviations

Bruins Holding b.v. is not liable for deviations in prices, pictures or texts.

§3. Receive, return and complaint of an order

After receiving an order, the customer must check the goods at the function and correctness. If a product is defective or incorrect, the customer is obliged, to immediately notify Bruins Holding b.v., however, the latest within eight days. Such notification must be in writing (letter, e-mail or fax).

The customer has the right, to send back a received order to Bruins Holding b.v., Tooropstraat 23, 6901 DE Zevenaar, The Netherlands, within eight days and without giving any reason. (Validity is date of postmark). In this case shipping costs must be paid by customer.

In this period of eight days, customer can send back unused goods, that means, not worn, washed or used goods, thus undamaged and in original packaging. After elapse of the survey period of eight days, the purchase will be irrevocably.

Is an order sent back, within eight days, the purchase price will be wired back onto the customers account, after the receiving of the returning goods.

§4. Liability

Bruins Holding b.v. is not liable for the wrong or improper use of the ordered products. The customer is oblige to read the instructions, before the use of a product. In case that a description or instruction is unclear, the customer can contact Bruins Holding b.v. for help.

In the case of liability by Bruins Holding b.v., is the maximum amount of liability, the purchase amount of the relevant product.

§5. Personal data and security

Personal data will be added to the customer data-base of Bruins Holding b.v. and should not be made available to third parties. Bruins Holding b.v. is not liable for unauthorised acquisition of knowledge by third parties (e.g. hackers).

§6. Shipping information

We send to:

Orders are shipped immediately, after Bruins Holding b.v. received the invoice amount. The amount of an invoice can be wired to the account from Bruins Holding b.v. at Rabobank Netherlands.

Delivery times of an order, after receiving the payment:

-for The Netherlands ca. 1-2 (work)days
-for Germany ca. 2-3 (work)days
-for all other EU countries ca. 2-5 (work)days

These delivery times are not guaranteed and dependent on the good functioning of the transport company.

Bruins Holding b.v. reserves the right to amend its general terms of business at all time.

§9. Place of jurisdiction and concluding provision

With regard to the agreement between Bruins Holding b.v. and customer Netherlands law applies. The place of jurisdiction is Arnhem.
If any provisions are invalid or contain loopholes, the remaining provisions remain unaffected by this. Invalid provisions or provisions containing loopholes must be upheld with a valid content that comes as close as possible to the intention of the invalid content.
Only the Dutch test of these general terms of business is binding. If any provisions are invalid or contain loopholes, the other provisions remain unaffected by this.
